A HIGH SCHOOL MAY NOT BE ABLE TO PUNISH A STUDENT FOR SMOKING

If the student is at least 18 years old, and smoking off school grounds 
 
Attorney general wayne stenehjem issued his legal opinion today. 
 
It goes back to a dispute in april, when a hillsboro high school student was bannned from senior prom. Stenehjem says leona Fitz Patrick smoking was legal and didnt disrupt the educational process. 
 
He says the school boards action to keep her away from the dance was unreasonable.
 
STENEHJEM Says a smoking ban could be applied to members of high school sport teams, Because they are  “role models” for the school. 
 
But he says Fitz Patrick wasnt on a team, and she wasnt representing the school.
